What is an Agent of Record (AOR)?

Agent of Record (AOR) is an administrative intermediary service that lets a company engage independent contractors compliantly while still contracting with them directly. Acting as the AOR, Atlas HXM is your authorized agent for the administrative layer around the engagement — classification guidance, compliant onboarding, payment facilitation, and ongoing compliance support — but never becomes the contracting party itself.

Where is AOR available?

AOR is currently available in Brazil, Canada, India, Italy, the United Kingdom, and the United States. We’re expanding to additional countries soon.

What’s the difference between AOR and EOR?

EOR is for employees; AOR is for independent contractors. Under Employer of Record (EOR), Atlas HXM becomes the legal employer and runs payroll. Under AOR, Atlas HXM has no employment relationship with the contractor — it acts only as your authorized agent, and you contract with the contractor directly. The two are execution paths that follow from the worker classification decision, not competing products.

What’s the difference between AOR and Contractor of Record (COR)?

The decisive difference is who holds the contract. Under Contractor of Record (COR), the provider becomes the contracting party with the contractor. Under AOR, you keep the direct contract with the contractor and the provider acts only as your authorized agent. Atlas HXM offers AOR, not COR.

Is Atlas HXM the contractor’s employer or the contracting party?

No. In an AOR engagement, your company contracts directly with the independent contractor. Atlas HXM is your authorized agent for the administrative layer only — it is not the employer and not a party to the contract between you and the contractor.

What does the Classification Protection cover?

If a contractor Atlas HXM has classified is later found to be misclassified, Classification Protection helps cover the financial costs — it is not a promise that a classification is guaranteed “correct,” or that misclassification can’t happen.

Reimbursement covers documented reclassification costs, back taxes, and unpaid employer-side taxes (excluding penalties, interest, and liquidated damages), up to $100,000 per contractor and $1,000,000 in the aggregate per client, subject to eligibility and exclusions in your Atlas HXM AOR services agreement. Amounts exceeding these limits are not covered. All reimbursement claims must be made to Atlas HXM within 12-months from the latest classification assessment and no material change has occurred to the factors on which the original classification was based (including role scope, responsibilities, work location, or engagement terms). How does Atlas HXM classify workers — is this legal advice?

Atlas HXM provides worker classification guidance and assessment, never a legal determination or legal advice. Classification is driven by the details of the working relationship, with rules varying by each jurisdiction, which is why accurate classification is what keeps a cross-border engagement compliant.

How much does Atlas HXM’s AOR cost?

Atlas HXM’s AOR price is $199 per contractor, per month — billed monthly, cancel anytime*. This is one price covering onboarding verification (KYB/KYC) and contractor payment facilitation.**

  4. Final onboarding depends on the information you and your contractor provide. SLAs measured in business days from point of client request; exclude third-party dependencies (e.g., background checks).

  5. Conversion credit is subject to eligibility and terms. To qualify, the crediting assessment must be the first Atlas HXM classification assessment to return an "employee" outcome for the worker in question; a worker who received an "employee" outcome from an earlier assessment is not eligible. The worker must also be onboarded as a Worksite Employee (WSE) under Atlas HXM's EOR service within 30 days of the assessment result. Where circumstances outside the client's control make onboarding within 30 days impractical, Atlas HXM may apply the credit on a case-by-case basis.
