Employee benefits in Hong Kong combine Mandatory Provident Fund contributions, statutory paid leave, statutory holidays, work-injury insurance, rest days, minimum-wage protections, and termination-related payments. Employers generally contribute 5% of relevant income to MPF, while the statutory minimum wage is HKD 43.10 per hour.
Competitive Hong Kong packages typically add private medical coverage, dental support, wellness programs, learning budgets, flexible-work arrangements, and contractual 13th-month payments. These additions are market practices rather than legal entitlements.
Mandatory benefits for employees in Hong Kong include MPF retirement savings, statutory leave, rest days, statutory holidays, minimum-wage protection, compulsory employees' compensation insurance, and qualifying severance or long-service payments. The table summarizes the main employer obligations.
Benefit | Entitlement / rate | Legal basis |
|---|---|---|
Mandatory Provident Fund Retirement Savings | Employer: 5% of relevant income. Employee: 5% of relevant income, with no employee contribution below HKD 7,100 monthly. Maximum relevant income: HKD 30,000 monthly; maximum contribution: HKD 1,500 monthly each. | Mandatory Provident Fund Schemes Ordinance (Cap. 485). |
Statutory Minimum Wage | HKD 43.10 per hour. | Minimum Wage Ordinance (Cap. 608). |
Rest Day | At least 1 rest day in every period of 7 days for employees under a continuous contract. Whether the rest day is paid is contractual. | Employment Ordinance (Cap. 57). |
Statutory Holidays | 15 statutory holidays. Employees under a continuous contract for at least 3 months receive holiday pay equal to average daily wages. Work requires an alternative holiday. | Employment Ordinance (Cap. 57) and Employment (Amendment) Ordinance 2021. |
Paid Annual Leave | 7 to 14 paid days per completed 12-month period under a continuous contract, increasing with service. | Employment Ordinance (Cap. 57) and Employment (Amendment) Ordinance 2025. |
Sickness Allowance | Up to 120 accumulated paid sickness days, paid at 80% of average daily wages for qualifying leave. | Employment Ordinance (Cap. 57). |
Maternity Leave | 14 weeks, with qualifying pay at 80% of average daily wages. Reimbursement for weeks 11 to 14 is capped at HKD 80,000 per employee. | Employment Ordinance (Cap. 57) and Employment (Amendment) Ordinance 2020. |
Paternity Leave | 5 days for each confinement, with qualifying pay at 80% of average daily wages. | Employment Ordinance (Cap. 57) and Employment (Amendment) (No. 3) Ordinance 2018. |
Severance Payment | For qualifying redundancy, lay-off, or redundancy-related fixed-term expiry after 24 months: two-thirds of last full month's wages, capped at HKD 15,000 per reckonable year, up to HKD 390,000. | Employment Ordinance (Cap. 57). |
Long Service Payment | For qualifying termination events after 5 years: two-thirds of last full month's wages, capped at HKD 15,000 per reckonable year, up to HKD 390,000. | Employment Ordinance (Cap. 57). |
Work-Injury Compensation Insurance | Compulsory cover of at least HKD 100,000,000 per event for no more than 200 employees, or HKD 200,000,000 for more than 200 employees. | Employees' Compensation Ordinance (Cap. 282). |
Employers and employees aged 18 to 64 generally each contribute 5% of relevant income to MPF. This applies to full-time and part-time employees unless an exemption applies. For monthly-paid employees, employer contributions begin from the first day of employment; employee contributions are not due during the first 30 days. Employee contributions are zero below HKD 7,100 monthly, while the relevant-income ceiling is HKD 30,000 and each party's maximum mandatory contribution is HKD 1,500 monthly. See the current MPF contribution thresholds.
Employees under a continuous contract receive paid annual leave after each completed 12-month period. Entitlement starts at 7 days in the first and second years, rises to 8 days in year 3, and increases annually to 14 days from year 9 onward. From 18 January 2026, the continuous-contract test requires 4 weeks of continuous employment and either 17 hours in each week or 68 hours across a rolling 4-week period where a week falls below 17 hours. Official annual-leave guidance reflects the Employment Ordinance (Cap. 57) and Employment (Amendment) Ordinance 2025.
Paid sickness days accrue at 2 days for each completed month during the first 12 months of employment and 4 days for each completed month thereafter, up to 120 days. Qualifying sickness allowance is 80% of average daily wages. Employees generally need a continuous contract, sufficient accrued paid sickness days, an appropriate medical certificate, and at least 4 consecutive sickness days. The Employment Ordinance (Cap. 57) sets these protections.
Eligible employees receive 14 continuous weeks of maternity leave. Maternity leave pay is 80% of average daily wages for employees with at least 40 weeks of continuous service before scheduled leave who meet the notice requirements. The employer pays on the normal payday, and the government reimburses statutory pay for weeks 11 through 14 up to HKD 80,000 per employee. The Employment Ordinance (Cap. 57) and Employment (Amendment) Ordinance 2020 govern this entitlement.
Fathers and fathers-to-be are entitled to 5 days of paternity leave for each confinement. The days may be taken together or separately from 4 weeks before the expected delivery date until 14 weeks after the actual delivery date. Qualifying paternity leave pay equals 80% of average daily wages and generally requires 40 weeks of continuous employment plus statutory notice and supporting documentation. The Employment Ordinance (Cap. 57) and Employment (Amendment) (No. 3) Ordinance 2018 apply.
Hong Kong has 15 statutory holidays. Employees under a continuous contract for at least 3 months receive holiday pay based on average daily wages. Employers may require work on a statutory holiday only by granting an alternative holiday within 60 days before or after the holiday, subject to notice rules; there is no statutory premium-pay multiplier. Easter Monday became a statutory holiday under the Employment Ordinance (Cap. 57) and Employment (Amendment) Ordinance 2021.
Different end-of-service formulas apply by trigger. Redundancy, redundancy-related fixed-term expiry, and lay-off can trigger severance after 24 months; qualifying termination, non-renewal, death, permanent unfitness resignation, and age-65-or-over resignation can trigger long service payment after 5 years. Both use two-thirds of last full month's wages, capped at HKD 15,000 per reckonable year, up to HKD 390,000. Under the Employment Ordinance (Cap. 57), mandatory MPF benefits may offset only the pre-1 May 2025 portion for service spanning that date.
All employers must maintain employees' compensation insurance for all employees, regardless of contract length, working hours, or full-time, part-time, permanent, or temporary status. Premiums are commercially determined by the insurer and risk profile rather than set as a statutory percentage. The Employees' Compensation Ordinance (Cap. 282) requires minimum cover per event of HKD 100,000,000 for policies covering no more than 200 employees and HKD 200,000,000 for larger policies. Official insurance guidance explains the requirement.
Hong Kong has no general statutory ordinary daily or weekly working-hours cap for adult employees; hours are primarily set by contract. There is also no general statutory maximum total working-hours or workplace-span limit including overtime for adult employees. No general statutory overtime premium or multiplier applies, and overtime pay or time off is contractual. Young persons aged 15 to under 18 in industrial undertakings are an exception: they are generally limited to 8 hours a day and 48 hours a week and cannot work overtime. The statutory minimum wage is HKD 43.10 per hour for broadly covered employees under the Minimum Wage Ordinance (Cap. 608), as reflected in Labour Department guidance.
The following benefits are common market enhancements in Hong Kong, not statutory entitlements. Package design commonly varies by seniority, sector, workforce profile, and insurer terms.
Employer-paid group inpatient and outpatient medical coverage is typical for professional roles, while dependent coverage is often optional or employer-subsidized. Typical employer medical costs are HKD 9,000-18,000 per employee per year. Dental reimbursement or panel-dental coverage is also a common enhancement, with typical dental and vision costs of HKD 800-3,000 per employee per year. Vision coverage is less commonly offered as a standalone benefit.
Typical wellness packages include confidential EAP counseling, telehealth, wellbeing apps, and modest fitness allowances, often costing HKD 300-1,200 per employee per year. Learning and development is also a common professional-market benefit, with training expenditure or budgets typically representing 3.1%-4.0% of annual base salary. On a HKD 600,000 salary, that is approximately HKD 18,600-24,000 annually.
Hybrid schedules, flexible start and finish times, and occasional remote-work days are common market practices for eligible office roles. There is no general statutory right to request flexible work in Hong Kong. Employers typically document eligibility, attendance expectations, equipment ownership, expense reimbursement, data security, health and safety, and injury-reporting processes. Flexible arrangements do not remove employment, MPF, employees' compensation, or anti-discrimination obligations.
A guaranteed 13th-month payment is customary in many Hong Kong packages but is not a universal statutory benefit. Where offered, it is typically one additional month of base salary, or 8.33% of annual base salary. Variable annual bonuses commonly range from 1.0 to 1.8 months depending on level and company performance. Clear contract terms should address eligibility, proration, payment timing, and treatment of employees who leave.
Employer cost is driven by base pay, mandatory MPF contributions, insurance, and the level of voluntary benefits offered. Medical plan design, training investment, and contractual bonuses can materially change the total package.
Cost Line | Typical Employer Cost | Notes |
|---|---|---|
Group Medical Insurance: Employee Inpatient Plus Outpatient Cover | HKD 9,000-18,000 per employee/year | Typical range varies by plan richness, network, age mix, group size, and claims experience. |
Dental and Vision | HKD 800-3,000 per employee/year | Indicative cost; capped dental reimbursement is commonly used, while standalone vision cover is less prevalent. |
Wellness, Mental-Health, and EAP Support | HKD 300-1,200 per employee/year | Indicative cost for EAP, telehealth, and modest wellbeing support. |
Learning and Development | 3.1%-4.0% of annual base salary; HKD 18,600-24,000 on a HKD 600,000 salary | Typical training expenditure and budget range. |
Hybrid-Work Equipment and Remote-Work Allowance | HKD 1,000-5,000 per eligible employee/year | Indicative cost for equipment, peripherals, ergonomic support, and connectivity assistance. |
Guaranteed 13th-Month Payment | 8.33% of annual base salary | One additional monthly base salary where contractually guaranteed. |
Employer MPF Mandatory Contribution | 5% of relevant income, capped at HKD 18,000 per employee/year | Statutory employer contribution, included for total-cost context. |
For a professional earning HKD 600,000 in annual base salary, an illustrative package with a HKD 50,000 contractual 13th-month payment, HKD 18,000 employer MPF, HKD 12,000 medical cover, and selected supplemental benefits totals HKD 702,600 annually where the employee is MPF-covered. A genuinely MPF-exempt employee produces an illustrative total of HKD 684,600. Model your full package in our cost calculator.
1. Misclassifying Guaranteed Bonuses
Do not describe a recurring, formula-based, or guaranteed 13th-month payment as discretionary. Contract wording, handbook statements, payroll communications, and established practice can affect whether an end-of-year payment is enforceable.
2. Overapplying MPF Exemptions
Foreign nationality alone does not exempt an employee from MPF. Review visa duration and evidence of overseas retirement-scheme coverage, as employees staying beyond 13 months may become subject to MPF enrollment and contributions.
3. Ignoring Flexible-Work Documentation
Document working time, approved location, equipment, expenses, confidentiality, cyber security, injury reporting, and the employer's ability to amend the arrangement. Remote work does not remove statutory employment protections.
4. Handling Health Data Improperly
Use a Personal Information Collection Statement and limit benefit data to what is needed for administration. Restrict insurer and vendor access, avoid manager access to counseling information, and establish data retention and deletion controls.
5. Changing Benefits Without Clear Terms
Review contracts, employee communications, and past practice before reducing insured benefits or changing eligibility. Use clear reservation-of-rights language, objective criteria, and appropriate notice or consultation processes.

5% of relevant income is the mandatory employer MPF contribution. For monthly-paid employees, the employer contribution is capped at HKD 1,500 per month because relevant income is capped at HKD 30,000 monthly.
14 weeks is the statutory maternity-leave duration. Other qualifying leave includes 5 days of paternity leave, up to 120 accumulated paid sickness days, and 7 to 14 annual-leave days based on service.
HKD 100,000,000 is the minimum insurance cover per event for an employer with no more than 200 employees. Employers with more than 200 employees need at least HKD 200,000,000 per event under compulsory employees' compensation insurance.
5% MPF contributions generally apply to eligible part-time employees aged 18 to 64. Part-time employees can also qualify for continuous-contract protections after 4 weeks under the 17-hours-per-week or 68-hours-over-4-weeks test.
1 May 2025 is the transition date after which mandatory MPF accrued benefits cannot offset the post-transition portion of statutory severance or long service payment. For employment spanning that date, only the pre-transition portion may be offset.
